If we could predict, with 100% certainty, that someone is going to commit a violent act in the future (and letâ€™s say thereâ€™s nothing rehabilitatively) that we could do about it, should we wait for that person to commit that crime before punishing? Or should the govâ€™t step in and preemptively incarcerate that person? Why or why not? If predictive sentencing is about protecting future victims why should we wait until that offender has committed a crime?
